I refer to the above and please find enclosed a copy of the Offer we have now received for your property for your information. (However, please note that the agreement between you and the purchaser is not yet legally binding. The "missives" or contract will not become binding until such time as letters are exchanged between WJM and the solicitor acting on behalf of the purchaser and at this stage either party could still withdraw for any reason). In this respect, please note that the Offer refers to “the Scottish Standard Clauses”. I attach a “Client Guide” to the Standard Clauses, (which contains the Standard Clauses in section 3) and would advise you to read the terms of the Standard Clauses in conjunction with the terms of the Offer.
Please note the Offer is subject to the purchaser obtaining a mortgage offer of loan.
With regards to the terms of the Offer, I should be grateful if you could confirm and note the following:
You undertake that all systems (radiators, boiler etc) will be in working order commensurate with age at settlement. (Please note that the buyers will have a “warranty period” commencing five days after the date of entry to satisfy themselves regarding the working order of the same failing which you would not have any ongoing liability towards the buyers regarding the working order of the systems).
You have received no notice etc confirming any system is unsafe/dangerous.
You have had no “Neighbour Notifications” and no planning applications served on you with regard to any development to be carried out and have no knowledge of any development proposal which might affect the property.
You have not carried out any alterations which would have required planning permission from the planning department and building warrant consent from the building control department of the local authority.
You are not aware of any Council repairs or other notices affecting the property
You are not aware of any material common repairs proposed or outstanding.
The property has no solar panels or similar.
Are there any factors/property managers for the property?
Is the house fitted with compliant interlinked smoke/heat/carbon-monoxide alarms and detectors?
Is there a burglar alarm?
